What is a conveyancer?
A Conveyancer is a specialist attorney who handles the legal aspects of selling and buying property. Only an admitted attorney who has written and passed specialised exams can be a conveyancer in South Africa.
Who appoints the conveyancer?
The seller appoints the conveyancer. However, this can be varied by agreement between the parties. It is a misunderstanding that the estate agent appoints the conveyancer which is not the case.
What costs is the seller liable to pay in a property transaction?
The seller is liable to pay the following:
- Bond cancellation attorneys’ costs
- Rates clearance figures – advance rates, water, electricity payable to the municipality. The Conveyancer will obtain the required amount from the municipality during the conveyancing process.
- Levy clearance figures – advance levies payable to the body corporate (the Conveyancer will obtain the required amount from the body corporate during the conveyancing process)
- The costs to obtain the required compliance certificates (electrical, gas, electric fence, water)
- Agents Commission
